1. Acceptance of Terms

By accessing or using SuburbScan at suburbscan.com.au (the "Service"), operated by Yakhnov Studio, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

SuburbScan is a property intelligence platform that aggregates publicly available Australian government data and commercially-sourced property-market data to provide suburb and address-level insights including demographics, crime statistics, bushfire risk, coastal erosion, aircraft noise exposure, public transport access, school proximity, and other livability indicators. The Service is provided for general informational purposes only.

3. Accounts and Subscriptions

Most of the Service is free and needs no account: suburb, capital-city, state and tag pages, search, the ranked suburb lists, suburb comparisons, the Suburb Finder, the articles, and the calculators. An account and a subscription are needed for address-level property data.

• You may create an account using an email address and password, or by signing in with a supported third-party identity provider (currently Google). You are responsible for keeping your credentials confidential and for all activity under your account.
• Subscriptions are billed monthly through Stripe in Australian dollars at the price advertised on the /subscribe page. Payment information is collected, processed, and stored by Stripe — we do not receive or store full card details.
• You may cancel your subscription at any time from your account page. Cancellation takes effect at the end of the current paid period; no pro-rata refunds are issued for the unused portion of a period.
• You may delete your account entirely from your account page. Doing so cancels any active subscription, removes your customer record from our payment processor, and deletes your account — see the Privacy Policy for exactly what is removed.
• We may suspend or terminate your account if we reasonably believe it has been used in breach of these Terms or for fraudulent or abusive purposes.

4. No Professional Advice

The information provided on SuburbScan does not constitute professional advice of any kind, including but not limited to financial, legal, real estate, insurance, or planning advice. You should not rely solely on information from the Service when making property purchase decisions or any other significant decisions. Always seek independent professional advice appropriate to your circumstances.

5. Lender Referrals

Some pages offer to pass your details to a licensed mortgage broker. That is optional, it happens only if you fill in the form and tick the consent box, and we send only the name, mobile and email address you provide. We do not ask for your income, savings, deposit or borrowing capacity, and we do not collect them.

We may receive a referral fee if you take out a loan through a broker we referred you to. We are not a credit provider or a credit assistance provider: we do not recommend loan products, assess what you can borrow, or give credit advice. The broker is responsible for their own advice and their own obligations to you.

6. Data Accuracy and Limitations

While we strive to provide accurate and up-to-date information, we make no warranties or representations regarding the accuracy, completeness, or reliability of any data displayed on the Service. In particular:

• Data is sourced from third-party government and commercial databases and may contain errors, omissions, or delays.
• Crime statistics, bushfire risk scores, coastal erosion rates, aircraft noise contours, transport access scores, school distances, and demographic data are historical or derived indicators and do not predict future events.
• Risk scores are relative rankings and should be interpreted in context, not as absolute measures of safety.
• Suburb boundaries, population figures, and other data may not reflect the most recent changes.

Calculators on the Service — including stamp duty, first home buyer concessions and mortgage repayments — produce estimates from published rates and thresholds as they stood on the verification date shown beside each figure. Rates, thresholds and eligibility rules are set by government and change without notice to us, commonly at the start of a financial year and sometimes retrospectively. A concession may also depend on matters the Service cannot know, such as whether you have previously owned property, your residency, or how you intend to occupy the property. The amount you actually pay is determined by the relevant revenue office, not by this Service. Do not rely on a figure from a calculator here for a purchase decision, a contract, or a finance application without confirming it with that revenue office or your conveyancer. Each calculator links to the authority it was checked against.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Bulk-extract the Service's content — systematic copying, harvesting or automated downloading of pages or data — without our written permission. Ordinary browsing, and indexing by search engines and other crawlers that respect our robots.txt, are welcome. That file, not this clause, says what is open to automated access.
• Attempt to gain unauthorised access to any part of the Service or its underlying systems.
• Interfere with or disrupt the operation of the Service.
• Reproduce, redistribute, or commercially exploit the data or content from the Service without authorisation.
• Misrepresent your identity or affiliation when using the Service.

8. Intellectual Property

The Service, including its design, layout, graphics, and original content, is owned by Yakhnov Studio and is protected by Australian and international intellectual property laws. Government data displayed on the Service is used under the terms of its respective open data licences (such as Creative Commons Attribution). You may not copy, modify, or distribute our original content without permission.

9. Third-Party Services and Data

The Service may contain links to third-party websites or display data sourced from external providers. We are not responsible for the content, accuracy, or practices of any third-party sites or services. Your use of third-party resources is at your own risk.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law, or any other applicable law, that cannot lawfully be excluded or limited. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to resupplying the services or paying the cost of having the services supplied again.

Clauses 10, 11 and 12 are subject to this clause in every case.

11. Limitation of Liability

Subject to clause 9, and to the maximum extent permitted by Australian law, SuburbScan and Yakhnov Studio shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to damages arising from reliance on any information obtained through the Service, errors or omissions in data, or interruptions to the Service.

12. Disclaimer of Warranties

Subject to clause 9, and to the maximum extent permitted by Australian law, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, nor that the data presented is complete or current for every location.

13. Indemnification

You agree to indemnify and hold harmless SuburbScan, Yakhnov Studio, and their officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

14. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised terms.

15. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

16. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
